When is it okay to bar a service/guide dog?
I personally don't think it ever acceptible to bar a guide animal(I have one) but I would like to hear others thoughts on the subject.Am in ethical dilemma.When are the needs of one more important than the needs of another?
I have been told that I can't bring my dog in because people are allergic does that qualify as harm to others? Or is it just a convenient thing to say?
Generally speaking guide and service dogs are allowed in most places, but it is not unlimited. There are places where dogs, even very well behaved dogs do not belong. They are not allowed in certain sterile areas of hospitals, ie. intensive care units, operating theatres, delivery rooms, etc. They can be barred from entry to private homes if the person does not want them there, and from places of religious worship (seperation of church and state). They are not allowed in food preperation areas, ie the Kitchens of restuarants, but they are allowed in the main area. So if someone worked in a Kitchen the dog could not go to work with them. There are certain parts of zoos in which they are also not allowed, places where the public are able to directly interact with the animals, ie. in butterfly enclosures and the like.
The aim of the ADA is not to provide any person with any special privallleges but to try to ensure that people have a more equitable experience of society. It is also about reasonable accommodations. It would depend entirely on the situation as to whether it is reasonable to refuse access. Generally speaking allergies are not an exceptable reason to refuse access but it would depend on the situation. In a store for instance, people do not have to be near each other, and the person is simply coming and going. In school it would depend on whether the classes can be reorganised, whether the dog is really needed to work, etc. It would depend on what other accommodations the school is willing and has put in place so that the dog is not needed, and above all else whether the dog is needed to work at school. It is not reasonable to expect someone with a severe life threatening allergy to have to be so dopped up on medication that they are unable to function at school. But, if the dog was really needed, and other things could not be put in place to help the person then something really should be done to enable to dog to accompany the person to school. It may include extra grooming on the part of the handler, and covering the dog so that it will not not shed hair when in the school.
Having said that this is assuming the dog is behaving appropriately. Businesses do have the right to ask someone to take a dog outside if the dog barks, toilets inside or in some other way disturbs the place for others. This cannot be simply because of the dogs presence, but because the dog has done something it should not do.
If you are having problems the best place to go is the program which trained your dog. They should be offering back up support for life and they should also be willing to help advocate on your behalf, and to help you to educate places you would like to go.
