My son is a minor and was terminated from his job after leaving the restaurant for a medical emergency.?
I believe my son's rights under the FMLA (Family Medical Leave Act) have been violated. Should I retain a lawyer?
The reason for termination was apparently because he left the establishment on the premise of "going to the bathroom and never returning to his shift." He informed his supervisor that he needed to go to the emergency room due to the intense pain he was experiencing from his chest but she apparently heard "restroom" (English is not her first language). After doing so, she relieved him of his position and he then proceeded to call me so that he could be taken to the ER. He did this after clocking out.
My son has a condition called pneumothorax(which causes portions of the lung or the lung itself to collapse) and other chest related conditions and has to be taken to the hospital often to monitor the condition.
I certainly wouldn't listen to any of the other advice you've gotten so far.
I wouldn't worry about setting a bad example for your son, it should be the resteraunt that is concerned about setting a bad example for the community. What your son has is a serious condition.
Absolutely, what the resteraunt did was awful, and you definately do have some options to consider, Although not neccessarily a lawsuit, and probably not under the family medical leave act. If your son disclosed his condition when hired, then the resteraunt may be found to have been in violation of the "americans with disabilities act". Even if your son did not fully disclose his condition, even if he lied on his application, the resteraunt is setting a bad example. Still the resteraunt has a right to hire whom they feel are best suited to perform the necessary tasks of the job, in this scenario, you would not win at trial, however you might get a small settlement if the resteraunt wishes to avoid bad publicity.
I have no respect for persons or establishments that are not socially responsible and would not normally advise this, but I say after you have weighed the pros and cons (remmember even if you get a settlement the attorney may take most of it in fees and expenses) of a lawsuit, do what you think is best. 1 option is also to become an activist, this could be organizing a group of family and friends and forming a picketing line to protest the resteraunt's action. If there is a sidewalk in front of the resteraunt, it should be perfectly legal to do this, you may need to register for a permit to do this however. Be careful that everything you say or print on signs are accurate and verifiable though, failure to do so could open yourself up to the possibility of being sued for slander. However, anything you say while under oath in a court of law is immune from slander and/or libel.
Like I said, I would not ordinarily advise anything other than look for another job, but if on the other hand, you work for the cause of bringing attention to your son's illness, as well as the socially irresponsible actions of so many in corporate america, I applaud you.
